Terms and Conditions

These Terms govern your use of the National AC Parts websites and app and your purchase of products from us.

1. Who we are

The National AC Parts websites and app are operated by CR Marine Pty Ltd (ACN 649 674 662) as trustee for the CR Marine Trust (ABN 94 677 957 449), trading as National AC Parts. This includes the National AC Parts brand sites (Actron, Daikin, Fujitsu and Braemar), any future National AC Parts daughter sites, and the app.

2. Accounts and App access

Access to the National AC Parts App is available to trade users who hold a valid Australian Refrigeration Council (ARC) or Electrical Work Licence. Purchases through our websites are open to both trade and retail customers. Where a part is purchased by a person who is not a licensed technician, installation and repairs must be carried out by a suitably qualified person; if they are not, the manufacturer-backed warranty may be void. This does not affect your rights under the Australian Consumer Law.

You agree to provide true, current and complete information and to keep it up to date. You are responsible for the security of your account; if you believe an order was not authorised by you, contact us and we will investigate it as an unauthorised transaction.

3. Quotes and product selection

All quotes are valid for 30 days. It is your responsibility to confirm that the units and parts are correct for your application before purchasing. Where we assist with selection based on information you provide, we use due care and skill, but we rely on the information given and are not the technician on site. Nothing in this clause limits the consumer guarantee that services are provided with due care and skill.

4. Orders

All orders are subject to our approval. Stocked items ordered and paid in full before 1:00 PM AEST on a business day are aimed to be dispatched the same business day; see our Dispatch & Delivery Policy. You may cancel an approved order before it is delivered or supplied; if the order has already been dispatched, the refund will be less the shipping fee and a 20% manufacturer’s restocking fee. We may decline or cancel an order before supply, in which case we refund in full any amount you have paid.

5. Invoices, shipping and returns

All invoices are inclusive of GST unless otherwise stated. Dispatch, delivery and shipping charges are set out in our Dispatch & Delivery Policy. Warranty and returns are set out in our Warranty & Returns Policy. Where those policies and these Terms address the same matter, the specific policy applies.

6. Communications and marketing

We will send you transactional and service messages necessary for your orders. We will only send marketing communications where you have opted in, and you can withdraw consent at any time using the unsubscribe link in any message. Agreeing to these Terms is not conditional on receiving marketing.

7. Privacy

We handle your personal information in accordance with our Privacy Policy.

8. Intellectual property and changes to these Terms

The websites, app and their content are owned by CR Marine Pty Ltd. You must not copy, imitate or use our URLs, content, logos or graphics without our prior written consent. We may update these Terms from time to time; we will publish the updated Terms with a revised “last updated” date, and material changes will take effect on reasonable notice.

9. Availability

Access to the websites and app may occasionally be unavailable due to maintenance, faults or causes outside our control. To the extent permitted by law, and subject to the consumer guarantees, we are not liable for loss arising solely from the websites or app being temporarily unavailable.

10. Governing law

These Terms are governed by the laws of Queensland, Australia, and the parties submit to the non-exclusive jurisdiction of the courts of Queensland. By using the websites or app you agree to these Terms, the Privacy Policy and the Warranty & Returns Policy.
